Welcome to DivaRice ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of divarice.com and all related services, including the purchase of products (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. ELIGIBILITY

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent that you meet this requirement.

2. PRODUCTS AND DESCRIPTIONS

We strive to provide accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions, images, pricing, or other content is accurate, complete, reliable, current, or error-free. If a product offered through the Services is not as described, your sole remedy is to return it in unused condition in accordance with our Return Policy.

Diva Rice is a food product made from konjac root, psyllium husk, and seaweed extract. It is not a medical product, pharmaceutical, or dietary supplement.

The information provided on this website, including nutritional information, health benefits, and dietary claims, is for general informational purposes only and is not intended as medical advice. Statements regarding the dietary properties of our products have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

You should consult a qualified healthcare professional before making any dietary changes, particularly if you have food allergies, sensitivities, or medical conditions including but not limited to diabetes, kidney disease, or gastrointestinal disorders. Individual results may vary.

While our products are manufactured in an FDA-registered facility, FDA registration does not constitute FDA approval or endorsement of any product.

4. ALLERGEN NOTICE

Our products are manufactured in facilities that may process other food allergens. While we take precautions to prevent cross-contamination, we cannot guarantee that our products are free from all allergens. Please review ingredient lists carefully before consuming.

5. ORDERS AND PAYMENT

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information.

Payment is processed securely through Shopify's PCI-DSS compliant payment infrastructure. We do not store your payment card details. By submitting an order, you represent that all payment information provided is accurate and that you are authorized to use the payment method.

Prices are listed in US dollars and are subject to change without notice. Applicable taxes and shipping charges will be calculated at checkout.

6. SHIPPING AND DELIVERY

We currently ship within the United States only. Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other circumstances beyond our control.

Risk of loss and title for items purchased pass to you upon delivery to the carrier. We are not liable for packages lost, stolen, or damaged after delivery to the carrier.

7. RETURNS AND REFUNDS

Returns are governed by our Return Policy, which is incorporated into these Terms by reference. Please review our Return Policy at divarice.com/returns for full details on eligibility, timeframes, and procedures.

8. SUBSCRIPTIONS

If you enroll in a subscription plan, you authorize us to charge your payment method on a recurring basis at the selected interval until you cancel. You may pause or cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle.

9. INTELLECTUAL PROPERTY

All content on the Services, including text, graphics, logos, images, recipes, and software, is the property of DivaRice or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

The DivaRice name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use such marks without our prior written permission.

10. USER CONTENT

By submitting reviews, testimonials, comments, or other content to the Services, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, and display such content in any media worldwide.

You represent that any content you submit is accurate, does not violate any third party's rights, and complies with applicable law.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVARICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless DivaRice and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

14. GOVERNING LAW AND DISPUTES

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Brooklyn, New York, and you hereby consent to the personal jurisdiction and venue therein.

15. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Services. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and DivaRice regarding the Services and supersede all prior agreements and understandings.
